These Terms include all of the provisions further contained in the Sugoii X Apparel Privacy Policy and acceptance of these Terms include acceptance of the Privacy Policy.

1.   General Information

1.1. This website is operated by Sugoii X Apparel PTY (Ltd), registered in South Africa. Throughout the site, the terms “we,” “us,” and “our” refer to Sugoii X Apparel.

1.2. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

1.3. We reserve the right to update, change, or replace any part of these Terms & Conditions by posting updates or changes to our website. Your continued use of the site after any such changes constitutes acceptance of those changes.

1.4. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

2.   Eligibility

2.1. By using this site, you represent that you are at least the age of majority (i.e You are 18 (eighteen) years of age or older and of full legal capacity) in your city or province of residence, or that you have given us consent to allow any of your minor dependents to use this site, or that a legal guardian/ parent provides supervision to enter into any binding agreement or use of the website or third-party services related.

2.2. We reserve the right to refuse service to anyone for any reason at any time.    

3.   Products and Pricing

3.1. All products listed on our site are subject to availability. We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction.

3.2. We reserve the right to discontinue any product at any time. Prices for our products are subject to change without notice.

3.3. We have made every effort to display as accurately as possible the colours and images of our products. However, we cannot guarantee that your electronic device’s display of any colour will be accurate.

3.4. Sugoii X Apparel and its online store(s) serves as a business in the retail industry which markets custom merchandise, apparel and accessories, and nothing else; no other items will be billed or shipped from this site unless notified on its website and platforms.

3.5. All products and clothing are 100% authentically checked. We do not sell, accept, or otherwise deal with fakes or factory variants. Buy with confidence as all items offered for sale are thoroughly inspected by experienced staff and/or partners within our network of operations for condition and authenticity.

3.6. Sugoii X Apparel does engage with reputable Third-Party Sellers and providers that collaborates on products and clothing on the website and platforms for sale.

4.   Orders and Payment

4.1. By placing an order, you agree to purchase a product subject to our Terms & Conditions. All orders are subject to availability and confirmation of the order price. Orders will be confirmed and billed via the email address provided on the order form.

4.2. We accept various payments through PayFast (local customers) and PayPal (international customers). Please enquire for assistance on how-to-order. You agree to provide current, complete, and accurate purchase and account information for all purchases made on our website.

4.3. Approved payment gateways use the strictest form of encryption, they employ top-tier security measures. With advanced encryption, regular security audits, and PCI-DSS Level 1 compliance, both merchants and customers can transact with peace of mind. Users may go to https://payfast.io/security-fraud/ & https://www.paypal.com/za/webapps/mpp/paypal-safety-and-security to view their security certificate and security policy.

4.4. Sugoii X Apparel has no access to card details entered by the clients on PayFast and PayPal secure sites.

4.5. The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

4.6. Sugoii X Apparel has currency converter functionality. The figures displayed are updated automatically from Nova: Currency Converter throughout the day. Sugoii X Apparel is not responsible for slight differences in fees.

4.7. We reserve the right to refuse any order placed. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or phone number provided at the time the order was made.

4.8. Final invoice amount to be paid in full before shipping. Goods will only be shipped once full amount reflects in sender's account.

4.9. Orders with incorrect billing information, or requiring additional verification, will be delayed.

5.   Shipping and Delivery

5.1. We ship worldwide from South Africa. Shipping costs and estimated delivery times will vary depending on the destination country.

5.2. We are not responsible for delays due to customs clearance or other international shipping-related delays.

5.3. Orders received from outside the borders of South Africa will be billed accordingly and shipping charges can be seen upon checkout as they are not included in item prices. The customer is responsible for any customs duties, import taxes, or fees that may be imposed by your country upon delivery.

5.4. Delivery fee for orders within South Africa under R2500 and international orders under R5000 will include a shipping fee calculated at checkout.

5.5. Delivery times may vary from 5-14 business days (excluding weekends and public holidays) depending on the dispatch load and when we receive your cleared payment, and/or are subject to signature authorisation.

Orders placed before 1PM on any given day usually dispatch the same day. Customers will be contacted in the event of a stock issue or a delay of dispatch.

5.6. A tracking number for each order will be provided via email upon shipment.

5.7. International delivery can take anywhere from 5-30 working days to arrive, depending on customs. However, the average is 7 working days.

5.8. We will only deem a package lost if it has not arrived at the destination after 60 days. At this stage we will issue a full refund and make arrangements with the customer. 

5.9. All orders are shipped boxed or wrapped with relevant labels.

5.10. Shipments go out Monday through Friday, not including public holidays.

6.   Returns and Refunds

6.1. Our return policy lasts 14 days (inclusive) from date of delivery/collection. If the return period has expired, we cannot offer a refund or exchange.

6.2. To be eligible for a return, your item must be unused and in the same condition as received. It must also be in the original packaging. Returns are accepted in very specific instances, and are subject to agreement to the returns policy and completion and acceptance of the returns form (please request via email).

6.3. Once your return is received and inspected, we will notify you of the approval or rejection of your refund. If approved, a credit will automatically be applied to your original method of payment within a certain number of days.

6.4. NOTE: We do not accept international returns/exchanges.

6.5. All sales are final. No refunds. This is most applicable to incorrect size choice by the customer.

6.6. Sugoii X Apparel takes no responsibility for returned packages with incorrectly provided addresses. Should a package be returned locally, a customer can opt for a refund less shipping fee, or to pay an additional shipping fee for a re-shipment. Additional fees may apply for apparel or merchandise with special or oversized packaging. In the case of internationally returned shipments, the customer is responsible for any and all additional shipping fees incurred.

6.7. Clearance & Sale product may not be refunded or exchanged. All Clearance sales are final and will not be accepted for refunds or exchanges. Please note that no returns or exchanges are accepted on discount or products with a pre-communicated release date including licensed apparel and merchandise, and also bulk orders.

7.   Intellectual Property

7.1. All intellectual property rights such as content on this website and all other platforms or stores, including but not limited to data, text, graphics, logos, images, trademarks, technology and software, databases, know-how, designs, programs, ideas and concepts, and publications, is the property of Sugoii X Apparel PTY (Ltd) that may or may not be licensed to the legal entity and protected by South African legislation and international copyright laws, treaties and conventions.

7.2. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the services and products, including but not limited to all the above mentioned IP without express written permission by us. Subject to the rights afforded to the user herein, all other rights to all intellectual property on this website are expressly reserved. 

8.   User-Generated Content

8.1. If you submit any user-generated content, including comments, suggestions, or other materials, you agree that we may use, reproduce, and modify such content for any purpose without compensation to you.

8.2. You agree not to submit content that is offensive, unlawful, defamatory, or violates any intellectual property rights.

9.   Limitation of Liability

9.1. Sugoii X Apparel PTY (Ltd) will not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of any of our services or products.

9.2. In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law.

10.   Governing Law

10.1. These Terms & Conditions and any separate agreements shall be governed by and construed in accordance with the laws of South Africa.

10.2. Any disputes arising from these terms or your use of our service will be subject to the exclusive jurisdiction of the courts in South Africa.

10.3. Sugoii X Apparel aims to take all reasonable steps to ensure compliance with the Consumer Protection Act, 68 of 2008 (the “CPA”), and Protection of Personal Information Act, 2013 (No. 4 of 2013) (the “POPIA”) and the principles outlined in Sections 50 and 51 of the Electronic Communications and Transactions Act, 2002, 25 of 2002 (the “ECTA”), and Regulation of Interception of Communications and Provision of Communication Related Information Act 70 of 2002 (the “RICA”), and National Credit Act, No. 34 of 2005 (the “NCA) where applicable.
